Abstract

The digital transformation process has emerged as an important growth and innovation catalyst as well as an agent for social transformation, which has influenced greatly the legal framework for data protection and cybersecurity. The widespread use of digital technology, including AI, cloud computing, and networking, has contributed to the worsening situation with regards to data privacy, cyber-attacks, and regulatory compliance. This review analyses the legal implications of digital transformation by focusing on how the relationship between data protection and cybersecurity has transformed in modern societies. Moreover, there is the need for the review is to consider the relation between data protection and cybersecurity where it is essential for one to understand the need to have an integrated approach that addresses the two concurrently. Comparisons may help in finding out the different ways that have been used by different jurisdictions when implementing the regulatory regimes and the need for cooperation on an international level. The review paper will further look into the impact of the new technologies like AI and IoT on the legal system and their ability to handle challenges brought about by changing dynamics of digital risks. It has been found out that adaptability, risk based and technologically neutral approach to law are essential in providing effective governance.
